CAP-CHEM (“we,” “our,” “us”) is a Canadian distributor of non-toxic, sustainable construction products sourced from the United States. 

By purchasing from us, you (“the customer”) agree to the following terms:

1. Product Use & Technical Responsibility

All products are intended for professional construction use. It is the customer’s responsibility to review all product data sheets, technical requirements, and compatibility before purchase. CAP-CHEM is not liable for improper application, misuse, or failure to follow technical guidelines.

2. Pricing, Taxes & Duties

All prices are listed in CAD. Applicable CAD taxes will be added at in upon quotation. Customs duties, import fees, and border charges are the customer’s responsibility and are not included in our invoices. Contact us for orders and quotations.

3. Payment Terms

CAP-CHEM accepts payments via cheque, credit card, and e-transfer. Cheques: All cheques must be issued by a registered business and accompanied by the business number and one (1) form of valid government-issued identification. Cheques are subject to clearance before the release of any products. Returned or dishonored cheques will incur an administrative fee of $100.00 and may result in the suspension of future cheque payments.

Credit Cards: Credit card payments are subject to authorization at the time of purchase. All declined transactions must be resolved before any orders are processed or shipped.

E-Transfers: E-transfer payments must be received in full prior to processing and shipment of the order. Customers are responsible for any fees associated with their financial institution’s transfer services.

Payment Due Dates: Payment must be made in full by the due date specified on the invoice. Late payments may be subject to interest charges of [2.9] per month, calculated from the invoice due date until the date payment is received in full.

4. Shipping & Processing

We aim to have orders are processed and delivered within 10 business days. Shipping times may vary due to carrier delays, customs clearance, or unforeseen circumstances. CAP-CHEM is not responsible for delays caused by carriers, border agencies, or natural events.

5. Returns & Refunds

No refunds on opened, used, or tampered products. Returns are accepted on unopened products only within 7 days of delivery. The customer is responsible for return shipping costs. To initiate a return, contact us at info@cap-chem.com for authorization. Unauthorized returns will not be accepted. Approved refunds (for unopened items) will be processed within 7–10 business days of receipt and inspection.

6. Damaged or Defective Products

Inspect shipments upon receipt of your order. Report any missing items, damage or defect within 48 hours with photos and order details to info@cap-chem.com. We will provide replacement or refund options if the issue is valid and confirmed.

7. Refill & Resale Restrictions

Refilling, repackaging, or reselling CAP-CHEM or affiliated products is strictly prohibited unless expressly authorized in writing by the original manufacturer/distributor. Unauthorized refilling or resale voids all warranties and may result in legal action.

8. Limitation of Liability

CAP-CHEM is not liable for indirect, incidental, or consequential damages, including but not limited to project delays, labor costs, or lost profits. Our liability is limited to the purchase price of the product.

9. Amendments

CAP-CHEM reserves the right to update these terms at any time. Updates will be posted on our website and effective immediately upon posting.
